Conditions set out below. If you do not agree to these Terms and Conditions in their entirety please leave this website. Please note that these Terms and Conditions apply to this online store only and do not apply to purchases made at our physical outlets. The www.glassxpressions.com website is provided solely for your personal use. You may not use this website for any commercial purpose.
1. ONLINE SHOPPING
1.1 We will take all reasonable care to ensure that all details, prices, photographic representations and descriptions of products appearing on the website are correct at the time when the relevant information was entered onto the system. We have made every effort to display as accurately as possible the appearances, colors, textures or finishes of our products that appear on the website. Information pertaining to sizes and dimensions are also approximate and given as indications only. Accuracy of color you see will depend on your monitor and computer equipment. We are therefore unable to guarantee that the product images are an accurate representation of the actual merchandise.
1.2 We will not be liable if, for any reason, the GlassXpressions website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all the GlassXpressions website.
2. ORDER PROCESS
2.1 All orders that you place on this website will be subject to acceptance in accordance with these Terms and Conditions.
2.2 Non-acceptance of your order may be due to any one or more of the following non exhaustive reasons:
1. The product you ordered is out of stock;
2. Our inability to obtain authorisation for your payment;
3. We have identified a pricing or product description error;
4. There is a system or procurement failure; and
5. Failed customer validation checks.
2.3 When you place an order on our website we shall email you an acknowledgement detailing the product you have ordered. This email is not an order confirmation or order acceptance from GlassXpressions.
2.4 Acceptance of your order and the completion of the contract between you and GlassXpressions will take place when your order is dispatched; we will email you that your order has been dispatched. We reserve the right to dispatch multiple orders separately.
2.5 A gift message facility is available on certain orders and is available for your own personal and strictly non-commercial use. We do not take any responsibility for the contents of messages communicated by you to a third party. Where you use this facility you agree that your message will not include any content that could be construed as defamatory, abusive, obscene, racist, offensive, harassing, threatening, vulgar or which could cause embarrassment or distress to any person. You agree not to impersonate any person, including but not limited to any of our employees or customers.
3. DELIVERY
3.1 All parcels will be delivered by carrier and will require a signature on delivery.
3.2 Please note that your delivery may take longer during sale or other busy periods. We are unable to guarantee delivery within any estimated time frame.
3.3 We will make every effort to deliver goods within the estimated timescales. However, delays are occasionally inevitable due to unforeseen factors or events outside our control, for example extreme weather, a flood or fire. GlassXpressions shall be under no liability for any delay or failure to deliver the products within estimated timescales.
3.4 Risk of loss and damage of product passes to you on shipping date. This is why we suggest you confirm insurance when purchasing online. GlassXpressions will not be responsible for any loss or breakage once parcel has been sent.
3.5 Insurance is provided to cover loss and breakages of item/s during transit for overseas orders (outside of the Maltese Islands). For full details about cover and claim procedures, please see clause 4 below. The fees are calculated as follows:
1. If the total amount of the item/s and shipping fee together comes to less than €250 insurance
cover is a flat fee of €10.
2. If the total of the item/s and shipping fee together comes to more that €250 insurance cover
is calculated as follows:
o €10 for the first €250
o 2% for remaining amount
3.6 Delivery cost and insurance is shown prior to you commencing to make payment. For bespoke or special delivery items a separate communication of delivery cost or adjustments may be made.
3.7 GlassXpressions will provide a tracking number and link for use of tracking number for each package shipped internationally. It is the responsibility of the customer to use this information to monitor progress and to see if there have been any problems with the local carrier processing delivery (carriers may not always leave a delivery attempt notification). Customer is then responsible for contacting the local postal carrier to arrange for completion of delivery.
If a shipment is returned to GlassXpressions the customer is responsible for the cost of res-sending the item/s and for fees charged to GlassXpressions for return shipment.
3.8 For next day delivery to Malta or Gozo addresses, please note that this is only possible when orders are placed between Monday and Thursday before 10am. Orders placed between Friday and Sunday will be delivered on Monday. This is according to stock levels. We will advise of any delays. Orders placed after 10am on the eve of a public/national holiday will be processed on the next working day (excluding Saturdays and Sundays) and next day delivery will be the following day.
3.9 GlassXpressions offers free delivery to customers in Malta within 20 working days of order (this excludes Saturdays, Sundays and public/national holidays). A minimum spend on the value of goods is required to qualify for free delivery. The minimum spend amount is at the discretion of GlassXpressions and can be revised at any time. The minimum spend is currently €50 and supersedes any previous amount that may have been advertised at an earlier time. Free delivery is not available to customers using promotional discount codes for their order.
3.10 GlassXpressions offers free delivery of items from Qormi pick-up point for collection. Items will be available within 5 working days of order (this excludes Saturdays, Sundays and public/national holidays). Customer is to print off the order and present the print-out at the Qormi collection point upon collection. We will inform customers of location and times for pick-up once the order is ready.
3.11 Should a delivery attempt to a Malta address by GlassXpressions prove unsuccessful due to there being nobody at the address we will arrange for a re-delivery if the customer wishes. This will be done at a charge of €5 paid by credit card in advance. Alternatively, the customer may opt to collect the item/s from the Qormi. If unsuccessful delivery is attempted by Malta Post the customer must follow Malta Post’s policy as advised at the time.
3.12 It is the customer’s responsibility to provide us with the correct and complete shipping/delivery address when placing the order. If this is wrong and the order is returned to us the customer is responsible for the ‘return to sender’ charges as well as the cost to re-send the item/s.
4. CLAIMING LOST ITEM/S OR BREAKAGES
4.1 Claims for items arriving broken with international shipping can only be made if insurance was taken at the time of placing the order. If insurance is not included, it is because you have opted out of the cover policy during the checkout process and assumed responsibility for any breakages. Our experienced packers will endeavor to pack orders carefully and protected at all times.
4.2 Insurance cover is provided ‘one way’ only (Malta to destination country). Insurance is not valid if the package is returned to us by customer or by carrier due to non-collection / non-delivery.
.4.3 To claim for goods lost in transit, please allow at least eight (8) weeks before opening a claim with us.
4.4 You may open a claim for suspected loss of goods by notifying us at sales@glassxpressions.com and we will open the case with our local carrier, MaltaPost. You will be informed of the claim having been initiated by return email.
4.5 This is the procedure for making a claim for receiving damaged goods (breakages) if you have taken out the insurance cover:
1. When the item/s arrive you will be asked to sign for the package/s and the following two (2)
options apply:
o If the condition of the box/es looks good, sign the delivery receipt and keep a copy. If a copy is not available, take a clear/focused photo of it with your mobile phone.
o If the box/es look damaged on arrival sign as follows: ‘box received damaged’ and keep a copy. If a copy is not available, take a clear/focused photo of it with your mobile phone. You should sign this way if in any doubt (i.e. even if the outer paper covering the box is torn). It is best to employ caution and sign this way where there are any imperfections to avoid a rejected claim.
2. If you find the item/s broken upon unpacking you will need to email sales@glassxpressions.com
with the following:
o Your GlassXpressions order number/s
o Brief description of the issue
o Attach copy/photo of delivery receipt
o Attach photos of box, packing material and damaged item/s
4.6 When the order is dispatched, GlassXpressions will send an email with tracking details as well as these instructions regarding insurance cover and claims. If you are ordering an item/s for a third party (perhaps as a gift) and shipping will be to that third party, it is your responsibility to forward this email to the recipient so that they are aware of the procedure and can track the shipping.
4.7 It is imperative that the email with all the above is sent to GlassXpressions on the above email address within 48hrs of delivery of item/s. A claim under this insurance cover is only applicable if all of the above instructions are followed. If they are not, GlassXpressions cannot be responsible for any loss or breakages.
4.8 When a claim for lost or damaged goods is settled, GlassXpressions will ship a replacement item to the client at no extra cost to the client.
4.9 Insurance cover is for like-for-like replacement only.
4.10 Refunds are not covered as part of this cover.
4.11 In rare instances, it may be necessary for a replacement item to be produced. GlassXpressions will inform client in such cases with an approximate production time expected.
4.12 Should a client wish to receive an alternative item of a higher value the difference for replacement item value, plus extra shipping costs will have to be settled prior to shipping.
5. RETURNS POLICY
5.1 The following Returns Policy applies to this online store only and does not apply to purchases made at our physical outlets. We take great pride in our reputation for quality and excellent value. It is important to us that you are completely satisfied with your purchase. If for any reason you do not absolutely love your selections, we will gladly issue a refund for the value of the merchandise. Returns will be accepted within 30 days of purchase. Items returned must be in original condition with no breakages etc.
5.2 Refund will be made using the same method as customer’s payment method and once the merchandise has been received.
5.3 Original shipping and handling fees are not refundable.
5.4 In the case of returns for damaged goods, GlassXpressions may, upon review of the case in question, agree to cover the costs incurred by customer for shipping the item/s back to us. In this case, the standard shipping option must be used unless expressly agreed otherwise in writing by GlassXpressions. Should the customer still choose to use another, more expensive service, the customer is responsible for paying the difference.
5.5 Where promotional discounts are applied to orders, the discount will be applied to each item in the basket. In the event of a return, you will not be refunded the discounted proportion. Additionally, any free promotional gift given with an order must also be returned if you are returning those goods to which the gift related.
5.6 Gift Vouchers are strictly non-refundable.
5.7 If item/s returned have been purchased with a gift voucher the client will receive a credit note for the value of the original voucher. If the item/s were of a higher value than that of the gift voucher and customer paid a further amount to make up the difference, that amount only will be due as a refund by whichever method that amount was paid (excluding original shipping and insurance costs).
5.8 All costs related to returning item/s back to GlassXpressions are to be borne by the customer returning said item/s.
5.9 Don’t forget to ask for proof of postage for your records. Please make sure that you obtain proof of posting as GlassXpressions will not be held responsible for any lost or damaged item and we reserve the right to charge the client for any such lost or damaged item/s.
5.10 In the event that a parcel is returned to GlassXpressions with a return fee and the parcel was shipped to the shipping address given by client, GlassXpressions reserves the right to forward the parcel return fee on to the client by either deducting the fee from the refund amount or as an extra fee if sending again.
5.11 Refunds on shipped goods will be made on balance after VAT, shipping and handling, shipping insurance, processing fees and any other costs have been deducted.
5.12 Products in our Sale section cannot be returned, refunded or exchanged.

6. PAYMENT METHODS
6.1 We only accept payment for orders in EUROS €
6.2 We accept payment by cash and personal cheques for orders being collected in person from MDINA GLASS or also major credit and debit cards for orders also being delivered.
6.3 If you choose to pay for an item using a payment card with a foreign currency denominated account, the account will still be taken in EUROS at the conversion rate applied by the relevant payment scheme at the time of processing your order.
6.4 We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your purchase and payment secure, but, in the absence of negligence on our part, we will not be liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the GlassXpressions website. You are responsible for checking the security measures offered by your chosen online payment method.
6.5 By making an offer to buy a product, you specifically authorize us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to, your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorization and to authorize
individual purchase transactions.
6.6 GlassXpressions is not responsible for accuracy of currency conversions shown on this website. The conversions are called in from a 3rd Party and are for approximate use only. Customers areresponsible for finally checking conversion rates, if they wish, from their own preferred source.
7. PRICING POLICY & IMPORT DUTIES
7.1 All prices are inclusive of VAT.
7.2 Although we try to ensure all our prices displayed on our website are accurate, errors may sometimes occur. If we discover an error in the price of an item you have ordered we will contact you as soon as possible. You will have the option to reconfirm your order at the correct price or cancel it. If we are unable to contact you, we will treat your order in respect of the incorrectly priced item as canceled.
7.3 GlassXpressions endeavours to ensure that all merchandise offered on the website is available at the same price in store. However, from time to time we may offer additional discounts for purchases online that do not apply in stores, or vice versa. Additionally, items offered as sets on this site may not be offered as part of a set within stores and individual prices may appl.
7.5 Any sale offers are subject to availability and may be withdrawn.
7.6 Your order may be subject to import duties and/or taxes, which are levied once your package reaches your country, if the country is outside the EU. For more information regarding your country’s customs policies, please contact your local customs office. As of 1st January, 2021 this applies to orders for the UK.

7.7 While we make every effort to ensure automated shipping charges are correct for individual products the final shipping costs may vary.This can only be determined upon packing. In this case, you will be notified of the extra charge prior to dispatch.
8. PRODUCT AVAILABILITY / INFORMATIONM
8.1 We feature products on our website that have been carefully selected for sale on the GlassXpressions website. Once an item is sold out it will be taken off the website at the earliest opportunity and may not be available again. Prices of products may change from time to time. Goods are subject to availability. As there is a delay between the time when your order is placed, and the time when the order is accepted, the stock position relating to particular items may change. If an item you have ordered becomes out of stock before we accept the order we shall notify you as soon as possible and you will not be charged for the out of stock items or we may offer to produce the out of stock items within our production schedule.
8.2 For out of stock items to be produced, we calculate a period of approximately eight (8) weeks. This can vary depending on quantities you require and factors beyond the control of GlassXpressions (for example; prior third party orders, general production schedules, workshop maintenance, disruptions to the glassmaking team and the time of year).
9. COPYRIGHT POLICY
9.1 Copyright and other intellectual property rights in any communications, ideas, or other materials submitted or offered to us by you through, on or by this website, unless specifically requested by us, shall become our property. You agree that submissions by you to this website must not risk infringing any right of any third party and in addition, you agree that no submissions by you to this website will
be or contain libelous or otherwise unlawful, abusive or obscene material or constitute an invasion of privacy. As such, you are and shall remain, solely responsible for the content of any submissions you make to the website.
9.2 You acknowledge and agree that the material and content contained within this website is made available for your personal non commercial use only and that you may only download such material and content for the purpose of using this website. Accordingly, we suggest that you do not use the GlassXpressions website to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content. Nothing contained in these Terms and Conditions shall be construed as conferring any license or right to use any trade mark, design right or copyright of the MDINA GLASS website.
10. MEMBER ACCOUNT, PASSWORD AND SECURITY
10.1 Registering and using the GlassXpressions website may involve you setting up an account and giving a password. You are fully responsible for maintaining the confidentiality of your account and the password, and all activities that occur under your account or password. You agree to immediately notify us of any unauthorized use of your account or password and any breach of security or misuse or suspected breach of security or misuse of the service, and ensure that you exit from your account at the end of each session if you use a shared computer. GlassXpressions cannot and will not be liable for any loss or damage arising from your failure to comply with this clause.
11. CONTENT/ACTIVITY PROHIBITED
11.1 Please choose carefully the information you post on the GlassXpressions website and that which you provide to other users. You must not misuse the GlassXpressions website. You will not: send or otherwise post unauthorized commercial communications to users (such as spam); upload viruses, trojans, worms, logic bombs or other malicious code; corrupt data; cause annoyance to others users; post content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence; use the GlassXpressions website to do anything unlawful, misleading, malicious or discriminatory; facilitate or encourage any violation of these Terms and Conditions.
11.2 We reserve the right, in our sole discretion, to reject, edit or refuse to post any content and to remove any content from the GlassXpressions website, whether or not the content is expressly prohibited by these Terms and Conditions, or to restrict, suspend, or terminate your access to all or any part of the Services at any time, for any or no reason, with or without prior notice, and without liability.
12. LIABILITY AND INDEMNITY
12.1 GlassXpressions shall not be liable for any direct, special, incidental, indirect or consequential damages including loss of profit or loss of opportunity that result from the use of, or the inability to use, the material on this website or the performance of the product purchased through the website or the conduct of other users of this website, even if GlassXpressions has been advised of the possibility of such damages.
12.2 The GlassXpressions website may also contain links to other websites, which are not operated by GlassXpressions. When you activate any of these you will leave the GlassXpressions website and we have no control over, and will accept no responsibility or liability in respect of, the material on any website which is not under our control.
12.3 You agree to indemnify us and our agents and officers, directors and employees, immediately on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these Terms and Conditions by you.
12.4 We may terminate your use of the website immediately if we consider that you have breached these Terms and Conditions.

Please note that, to provide some of our services, we may require further details from you.

16.1 The website is controlled and operated in Malta. Any Terms and Conditions concerning the usage of this website will be governed by the laws of Malta and any dispute concerning use of this website will be determined exclusively by the Maltese Courts.
17. GENERAL
17.1 We may change these Terms and Conditions at any time. If any of these Terms and Conditions are invalid or unenforceable, the remainder of these Terms and Conditions shall continue to have full force and effect.
17.2 We will not be responsible to you for any delay or failure to comply with our obligations under these Terms and Conditions if the delay or failure arises from any cause beyond our reasonable control.
17.3 If you breach these Terms and Conditions and we take no action we will still be entitled to use our rights and remedies in other situations where you are in breach.

18. ENTIRE AGREEMENT
